By registering to bid, you are agreeing to all of the following auction terms and conditions.
All items sold by Dynamite Auction Company are offered “as-is, where-is”, with no warranties or guarantees, either expressed or implied. All sales are final, and no refunds, returns, or exchanges will be permitted for any reason.
Accepted forms of payment include cash, check, cashier’s check, credit card, and wire transfer. A 10% buyer’s premium will be added to the final bid price on all items sold for less than $5,000, while a 5% buyer’s premium will apply to any item sold for $5,000 or more. All credit card transactions will be subject to an additional 4% processing fee, and credit card payments will not be accepted for purchases over $3,000. A $25 fee will apply to all wire transfers, which are accepted on Monday and Tuesday for online purchases.
All purchases are subject to a 9.5% sales tax unless the buyer presents a valid resale certificate or farm exemption card at the time of registration or settlement. No tax exemptions will be accepted after checkout. Payment in full is due on the day of the auction, and failure to remit payment as required may result in suspension of bidding privileges or other remedies available to Dynamite Auction Company.
A $15 title processing fee will be applied to all vehicle purchases. Temporary tags are available upon request for an additional $20 fee. Titles for vehicles, trailers, and other titled property will be mailed within thirty (30) days after cleared payment is received. Titles will not be issued on the day of the auction.
Purchased equipment will be available for pick-up beginning the Monday following the auction. All items must be removed within ten (10) business days unless prior arrangements have been approved. Buyers are solely responsible for all transportation of their purchases. Dynamite Auction Company assumes no liability for any loss, theft, damage, or injury occurring during transport.
All property is sold “AS-IS, WHERE-IS” with no warranties or guarantees, expressed or implied. The auction catalog and any advertising materials are provided as a guide only. While every effort is made to ensure accuracy, Dynamite Auction Company makes no representations regarding condition, authenticity, description, or completeness. Announcements made on the day of the sale take precedence over all printed and online materials.
Bidders are responsible for all bids placed under their account. Any bid placed constitutes a legal and binding contract to purchase, and it is the bidder’s responsibility to ensure the security of their account information.
In the event of non-payment, Dynamite Auction Company reserves the right to charge the credit card on file for the full invoice amount, including applicable fees, and to pursue any additional remedies permitted by law.
Items purchased through Dynamite Auction Company’s online bidding platform are subject to an additional 2% online purchase fee, in addition to the buyer’s premium. Items purchased through Proxibid or EquipmentFacts are subject to an additional 3% online purchase fee, in addition to the buyer’s premium.
